HMO Conversions Whitechapel

House to HMO conversions and licence upgrades in Whitechapel, fire doors, detection and shared amenities built to the council's licence standards.

HMO conversion in Whitechapel runs into planning and licensing controls at every step. Since 1 January 2021 a Tower Hamlets Article 4 direction has removed the right to turn a family house into a small HMO without planning permission. Houses are only 8% of homes in the valuation list count for the wider Whitechapel and Spitalfields area. The whole borough is also designated for additional HMO licensing, and the scheme names Whitechapel among its wards. So the realistic work is upgrading existing shared houses and flats to the council's licence standards, and occasionally a new HMO where the owner has consent.

If the building is listed, the works themselves are a separate question: anything that affects its character, inside or out, needs listed building consent from Tower Hamlets Council, and carrying it out without consent is a criminal offence.

In Whitechapel, a light HMO conversion for four to six tenants typically costs £40,000 to £75,000 in construction, or £90,000 to £150,000 with an en-suite to every bedroom (indicative London ranges, Mayfair Studio and LetCompliance, 2026). GS Renovation Ltd, a building contractor based in Potters Bar, does the work in Whitechapel: we build the fire doors, detection, bathrooms and kitchens to the council's HMO standards, the landlord applies for the licence, and a registered electrician certifies the electrics.

Planning an HMO in Whitechapel under the Article 4 direction

Nationally, Class L of the General Permitted Development Order lets a house change from a dwelling (C3) to a small HMO (C4) without planning permission. In Whitechapel that right has gone: the Tower Hamlets Article 4 direction removing it was approved by the Mayor in Cabinet on 29 January 2020 and came into force on 1 January 2021. An HMO for more than six people is sui generis under the London Plan glossary and needs planning permission everywhere, whatever the direction says.

The Local Plan adds a policy test to the application. Conversion to shared accommodation, including homes for multiple occupation, will be resisted, and Policy D.H7 supports new HMOs only where they meet an identified need and do not lose existing larger family housing. For a Whitechapel landlord, the realistic route is often improving an HMO that already has lawful use rather than creating a new one. The owner or their planning agent handles the application, and we build to what is approved.

Housing in Whitechapel

Around 9,330 homes make up Whitechapel on the valuation list; 92% are flats and 8% houses, and 19% date from before 1919, 8% from between the wars and 72% from after 1945.

Additional and mandatory HMO licensing across Whitechapel

Tower Hamlets designated the whole borough for additional HMO licensing on 25 October 2023, enforced from 1 April 2024 until 31 March 2029 unless revoked earlier. It covers privately let properties, including flats, occupied by three or more people forming two or more households, irrespective of the number of storeys. In Whitechapel, where most homes are flats, that brings shared flats into licensing as well as the few shared houses. Large HMOs, rented to 5 or more people forming more than 1 household, need a mandatory licence, except a flat in a purpose-built block of three or more flats, which the additional scheme covers instead.

The council says property licence applications are currently taking up to 12 months to complete, so the building work a licence depends on needs planning well ahead. The landlord applies for the licence, and the licence conditions become our brief: room sizes, kitchens, bathrooms, fire precautions and extraction. Renting out an unlicensed HMO can lead to an unlimited fine, so a Whitechapel landlord upgrading a shared flat schedules the works to finish before the council's inspection.

Room sizes and kitchens in a Whitechapel HMO under Tower Hamlets rules

Tower Hamlets adopted its own HMO amenity and room size standards at its October 2018 Cabinet meeting, and they set the layout of a Whitechapel HMO. A bedroom for one person must be at least 8.5 square metres, or 13 with kitchen facilities in the room, and a bedroom for two people 13 square metres, or 18 with kitchen facilities. Tower Hamlets will not accept any room below 6.5 square metres as a sleeping room in a licensed property under any circumstances. Underneath sit the national licence conditions: 6.51 square metres for one adult, 10.22 for two, and no sleeping room under 4.64, so 6.51 is the real floor for an adult.

Kitchens follow the same logic. The council's licensing guidance says kitchen facilities in shared housing should be no more than one floor away from the letting, so a tall Whitechapel terrace may need a second kitchen on an upper floor. In new conversions a mechanical extractor must be installed in addition to any openable window. We measure every room against these figures before the layout is drawn, because a room a few centimetres short cannot be let as a bedroom.

Fire safety, sound and energy in a Whitechapel HMO

Fire safety is often the largest single package in Whitechapel HMO works. The escape route through the hall and stairs is protected, bedroom and kitchen doors become fire doors with self-closers, and an interlinked fire detection and alarm system covers the rooms and the escape route. Building regulations Part B applies where the work is building work, the council's HMO fire standards apply through the licence, and the LACORS housing fire safety guidance is the recognised guide to what each type of property needs.

Sound and energy come next. Noise between lettings is a common complaint in shared houses, so separating walls and floors between bedrooms get added insulation where they are opened. On energy, since 1 April 2020 landlords cannot let, or continue to let, a property covered by the MEES Regulations with an EPC rating below E without a valid exemption. That applies to a Whitechapel HMO wherever it needs an EPC to be let. Loft and wall insulation, heating controls and efficient heaters go into the same programme.

FAQ

Frequently Asked Questions about HMO Conversions Whitechapel

What should a landlord budget for an HMO conversion in Whitechapel?

Start from £40,000 to £75,000 in construction for a light conversion (Mayfair Studio, 2026), or £90,000 to £150,000 with en-suites throughout. Then add planning where an Article 4 direction applies, the licence fee and the fire risk assessment. A Whitechapel quote follows a survey against the council's HMO standards, with fire works, bathrooms and kitchens as separate lines.

Can a Whitechapel house become an HMO without planning permission?

No. The Tower Hamlets Article 4 direction removing the right to change a dwelling (C3) into a small HMO (C4) came into force on 1 January 2021, so the national Class L right no longer applies here. An HMO for more than six people is sui generis and needs permission anywhere.

Does a Whitechapel flat shared by three friends need a licence?

Yes, if they form two or more households and rent privately. The Tower Hamlets additional licensing designation covers privately let properties, including flats, occupied by three or more people in two or more households, whatever the number of storeys. It runs from 1 April 2024 until 31 March 2029.

How long does a Tower Hamlets HMO licence take to come through?

Up to 12 months at present. Tower Hamlets says that, because of processing volumes, property licence applications are taking up to 12 months to complete. Owners of Whitechapel HMOs should apply early and plan any building work the licence conditions call for, so the property is ready when the inspection comes.

What is the smallest bedroom allowed in a Whitechapel HMO?

For an adult, 6.51 square metres under the national licence conditions, and Tower Hamlets will not accept any room below 6.5 square metres as a sleeping room in any circumstances. Its own standard asks for at least 8.5 square metres for a single bedroom, rising to 13 where the room has kitchen facilities, and 13 for two people.

How far can a shared kitchen be from the bedrooms in a Whitechapel HMO?

No more than one floor away from the letting, according to the council's licensing guidance for shared housing. In a tall terrace with bedrooms on three or four floors, that can mean a second kitchen upstairs, which adds drainage, extraction and a fire door to the scope.

What happens if a Whitechapel landlord lets an unlicensed HMO?

GOV.UK says renting out an unlicensed HMO can lead to an unlimited fine. With the whole of Tower Hamlets under additional licensing until 31 March 2029, a shared house or flat in Whitechapel needs its licence position settled before tenants move in, and the works the licence needs done on time.

When does a shared house count as a large HMO?

When it is rented to 5 or more people who form more than 1 household, GOV.UK defines it as a large HMO, which needs a mandatory licence. Smaller shared homes may still need a licence depending on the council area, and in Tower Hamlets the additional scheme covers three or more people in two or more households.

What fire safety work does a shared house usually need?

A protected escape route, fire doors with self-closers to bedrooms and the kitchen, and an interlinked detection and alarm system. The LACORS housing fire safety guidance sets out what suits each type and size of property, and the licence conditions confirm what is required for that address.
