What Harlow Council treats as needing approval

Harlow Council lists structural alterations to your house and underpinning your house among the works that need building control approval, alongside extensions, loft and garage conversions and drainage work. That list is the starting point for any alteration to the fabric. Approval is not the same thing as planning permission, and a project can need one, the other, both or neither. The building control route is about the Building Regulations, and structure is covered by Approved Document A.

Inspections are booked, not assumed. Harlow Council asks for site inspections to be booked through the free Local Authority Building Control app, or by phone, and a next day inspection has to be booked by 5pm the day before. That timing shapes the programme, because the officer needs to see foundations, bearings and steelwork before they are covered up. We book around the sequence of the work rather than at the end of it.

Heritage constraints on structural work in Harlow

Harlow Council records 168 statutory listed buildings and 26 locally listed buildings in the district. If your house is one of them, listed building consent is a separate consent and it can reach internal work as well as external. Policy PL12 of the Harlow Local Development Plan requires a Heritage Statement where development affects a heritage asset or its setting. That is a document to be prepared and submitted, not a box ticked on site.

Covenants are a further layer. Harlow Council states that restrictive covenants it administers can restrict residential extensions and external alterations, so covenant consent may be needed in addition to planning permission and building control approval. Three consents can therefore apply to one project, each with its own application and its own timescale. We establish which apply before the work is programmed, so nothing starts on a permission that has not been granted.

The stock: postwar estates and older buildings

Structural alteration in Harlow spans two very different kinds of building. Harlow Council's Mark Hall North character appraisal names eleven estates in the conservation area: Broomfield, Dovehouse Croft, Fesants Croft, Glebelands, Great Plumtree, Mark Hall Moors, Stackfield, Tany's Dell, The Chantry, The Gowers and The Lawn. The same appraisal records two storey houses there constructed with monopitch flat roofs, which are shorter than those built with gable roofs.

A monopitch or flat roof puts the load into the top of the house differently, so an alteration at first floor is not the problem it would be under a pitched roof with a load-bearing spine. Older buildings pose another question again. Harlow Council's Old Harlow appraisal records traditional materials and historic local building methods such as timber frames, tiled roofs and pargetting, in listed buildings ranging from the 15th, 17th, 18th and 19th centuries. In a framed building the engineer is reading a frame, not a set of masonry walls.

The ground under Harlow

The British Geological Survey maps the London Clay Formation, part of the Thames Group and described as clay, silt and sand, as the bedrock under most of Harlow. Under Old Harlow in the north east the mapped bedrock is instead the Thanet Formation and Lambeth Group, undifferentiated. The mapping comes from BGS 1:50,000 sheet 240, Epping. Where an alteration puts a new load on the ground, that difference belongs in the engineer's design rather than in a builder's assumption.

Superficial cover across Harlow is patchy rather than uniform. The BGS maps Lowestoft Formation till over much of Tye Green and Church Langley, and Head at Church Langley, but leaves other pockets of both areas with no superficial deposit mapped. Where nothing is mapped, the London Clay Formation is the material at rockhead. Two plots near each other can therefore sit on different bearing material, which is why trial holes and a site specific design beat a rule of thumb.

Two designations name that street. St John's Avenue sits in the Harlow Garden Village Estate conservation area, designated in 2013 and covering dwellings along St John's Avenue, Manor Road and The Hill. It is also named in one of the four Old Harlow Article 4 directions, which took effect on 1 June 2012. Conservation area status and an Article 4 direction are separate restrictions, so confirm with Harlow Council which applies to your part of the road.

Does a tree in the garden hold up structural work in a conservation area?

It can, because notice is required before the tree is touched. To carry out works to a tree in a Harlow conservation area you have to notify Harlow Council six weeks before you plan to start work. Harlow has ten conservation areas, among them Netteswellbury, Puffers Green, Tye Green and Harlowbury. Where access, scaffolding or a new foundation means branches or roots have to be dealt with, that six week notice goes in at the start.

The flat is in The Lawn. Can it be structurally altered?

Only with listed building consent and the freeholder's agreement. Harlow Council records The Lawn as the UK's first residential tower block, Grade II listed since December 1998, constructed in reinforced concrete with a brick finish. Listed building consent reaches internal work, and a reinforced concrete structure leaves an engineer very little to take out without a redesign. That consent is a separate application from building control approval, and both would apply.
