Chimneys in Mark Hall North need planning permission

In Mark Hall North the Article 4 direction requires planning permission for installing, altering or replacing a chimney on all parts of a house, whether it fronts a highway or not. The direction came into force on 28 October 2023 and applies to development started or made on or after that date. It does not cover flues or soil and vent pipes. That is a wider test than the visibility rule which applies to other works in the same area.

The council's position on removal is explicit. Harlow Council treats permanent removal of a chimney in Mark Hall North as an alteration needing planning permission. Its guidance states such removals "will not normally be acceptable", unless the chimney is considered dangerous or was not an original feature. An internal breast removal that also takes the stack is therefore a planning application in that area, with a real prospect of refusal. Establish that before you commit to a design or a budget.

Churchgate Street and Old Harlow chimneys

Churchgate Street and Old Harlow have their own Article 4 directions covering chimneys. The Churchgate Street direction is in place from 4 March 2026 and covers porches, canopies, chimneys and other exterior alterations. Its visibility test varies. Canopies and other exterior alterations are caught where visible from a highway, porches are caught in all cases, and chimneys are caught on all parts of a property. Rear extensions and hardstandings are not in its schedule, unlike the Mark Hall North direction, and it does not apply to flues or soil and vent pipes.

Old Harlow is covered by four Article 4 directions. Three took effect on 1 June 2012, covering Old Harlow, Park Hill and Mulberry Terrace, and St John's Avenue, and the High Street direction took effect on 27 February 2017. They remove permitted development rights for removing, altering or erecting a chimney, alongside alterations to the front of the house facing the road and building a front porch. The address, not the house type, decides which direction applies to you.

Listed buildings, conservation areas and chimney stacks

Harlow Council lists removing historic doors, fireplaces, plasterwork or panelling among the works that definitely need listed building consent, alongside adding an extension and demolishing part of a property. The council records 168 statutory listed buildings and 26 locally listed buildings in the district. Harlow also has ten conservation areas: Churchgate Street, Harlow Garden Village Estate, Harlow Mill and Old Road North, Harlowbury, Mark Hall North, Netteswellbury, Old Harlow, Puffers Green, Town Park Netteswell Cross and Tye Green.

Stacks can be a named part of an area's character. Harlow Council's Old Harlow appraisal identifies chimney stacks and chimney pots at regular intervals as a defining feature of the Park Hill area. It names tall stacks and engraved rectangular clay chimney pots on numbers 7, 9, 15 and 19 Park Hill. The council also states you need conservation area consent before you demolish any building or part of a building in a conservation area. Taking the breast out internally while the stack above is supported is one route that leaves the external character unchanged.

Where a planning application is needed, Harlow Council's householder validation checklist asks for a roof plan if your proposal will change the appearance, shape or position of your roof. That plan has to show all features of the roof, including any windows, roof lights, valleys and chimneys. Taking a stack down changes the roof, so that drawing forms part of the submission. Getting the validation requirements right first time avoids a returned application and a second wait.

Building control runs alongside. For alterations to a single dwelling where the cost of the work does not exceed £5,000, Harlow Council's building control charge under a building notice is £372.82 including VAT, on the fee schedule effective from 1 April 2024. Does taking a stack down need covenant consent from Harlow Council?
